Welcome to Asia Digital Bank Ltd. (“ADB”) (“us”, “we”, or “our”). ADB is a company incorporated under the Labuan Companies Act 1990 and is regulated by the Labuan Financial Services Authority.

This Privacy Policy is issued to all ADB’s customers pursuant to the requirements of the laws of Malaysia, including but not limited to the Personal Data Protection Act 2010 (“PDPA”), from whom personal data have been and/or may in future be collected.

2. Definitions

0.9. to design suitable digital banking products for customers including you;

0.10. to ensure our websites including its content are effective and friendly;

0.11. to understand your products and service requirements;

0.12. to comply with the requirements of any applicable law, regulations, policies, guidelines, requirements and etc;

0.13. to support and facilitate our internal audit and risk management purposes;

6. Retention of Your Personal Data

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods.

7. Transfer of Your Personal Data

Your information, including Personal Data, may be transferred to a location outside Malaysia if:

0.1. The Data Subject has given his consent to the transfer;

0.2. The transfer is necessary for the performance of a contract between the Data Subject and Data User;

0.3. The transfer is necessary for the conclusion or performance of a contract between the Data User and a third party which:

0.3.1. Is entered into at the request of the Data Subject; or

0.3.2. Is in the interests of the Data Subject.

0.4. The transfer is for the purpose of any legal proceedings or for the purpose of obtaining legal advice or for establishing, exercising or defending legal rights;

0.5. The Data User has reasonable grounds for believing that in all circumstances of the case:

0.5.1. The transfer is for the avoidance or mitigation of adverse action against the Data Subject;

0.5.2. It is not practicable to obtain the consent in writing of the Data Subject to that transfer; and

0.5.3. If it was practicable to obtain such consent, the Data Subject would have given his consent;

0.6. The Data User has taken all reasonable precautions and exercised all due diligence to ensure that the personal data will not in that place be processed in any manner which, if that place is Malaysia, would be a contravention of the PDPA;

0.7. The transfer is necessary in order to protect the vital interests of the Data Subject; or

0.8. The transfer is necessary as being in the public interest in circumstances as determined by the Minister.

If you are located outside Malaysia and choose to provide information to us, please note that we transfer the data, including Personal Data, to Malaysia and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

ADB will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

8. Disclosure of Data

We may disclose personal information that we collect, or you provide:

0.1. Disclosure for Law Enforcement

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities.

0.2.1. to our subsidiaries and affiliates;

0.2.2.3 a counterparty to a transaction that is entered into on your behalf;

0.2.2.4 any interested party that requests reasonable information, where you have defaulted in the performance of your obligations under an agreement with us or entered by us on your behalf; and/or

0.2.2.5 any legal, regulatory, governmental, tax, law enforcement or other authorities as required.

0.2.3. to fulfill the purpose for which you provide it;

0.2.4. for any other purpose disclosed by us when you provide the information;

0.2.5. with your consent in any other cases;

0.2.6. if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

9. Security of Your Personal Data

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

Our mobile app (where applicable) and websites may, from time to time, contain links to and from the websites of third parties that are not operated by us. If you click into a link to any of these mobile apps (where applicable) or websites, you will be directed to that third party’s site.

Please note that these mobile apps (where applicable) and websites have their own privacy policies. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services and any Personal Data made available by you on such sites will not have the benefit of this Privacy Policy and will be subject to the relevant third party’s privacy policy (if they have such a policy). Please check these policies before you submit any Personal Data to these mobile apps (where applicable) and websites.

In the event there are inconsistencies or conflict arising between the English and Chinese versions of the Privacy Policy, the English version shall prevail.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on our webpage.
